The FIFA Business – Part 1 – Where Does The Money Come From? - By Antoine Duval and Giandonato Marino

On next Thursday the 2014 World Cup will kick off in Sao Paulo. But next week will also see the FIFA members meeting on Tuesday and Wednesday at a much awaited FIFA congress. For this special occasion we decided to review FIFA’s financial reports over the last ten years. This post is the first of two, analysing the reports and highlighting the main economic trends at play at FIFA. First, we will study the revenue streams and their evolution along the 2003-2013 time span. In order to ensure an accurate comparison, we have adjusted the revenues to inflation, in order to provide a level playing field easing the comparative analysis over the years and types of revenues. Our first two graphs gather the main revenue streams into two comparative overviews. Graph 1 brings together the different types of revenues in absolute numbers, while Graph 2 lays down the share of each type of revenues for any given year (the others category covers a bundle of minor revenue streams not directly relevant to our analysis).

Since 2003, FIFA’s total revenues have more than doubled, from 685 Million$ to 1406 Million$. Its constant growth over the last decade turned negative only in 2011 and 2012 due to a fallout in broadcasting revenues (see below Graph 4). In terms of economic power this means that FIFA has doubled its financial capacity within ten years.  It has succeeded in developing new income streams, while also consolidating its traditional source of revenue: broadcasting rights.

Key to FIFA’s continuous enrichment were the broadcasting revenues. From 2006 to 2010 they nearly doubled from 391 Million$ to 779 Million$. A huge 100% jump! Since this peak, revenues have settled for a more modest amount of around 600 Million$, but still much higher than at the turn of the century. In any given year the broadcasting revenues represent 40 to 50% of FIFA’s total revenues. Thus, one can understand the paramount importance of broadcasting rights for the economic stability and health of FIFA. The progressive bite of the revised TV without frontier directive of the EU (revised in 1997), enabling countries to define certain World Cup games as “major events” which therefore must be broadcasted freely, might explain the recent fall in broadcasting revenues. In this context, recent decisions of the EU Courts, in cases T-68/08, C‑205/11 P and  C‑204/11 P reinforce the rights of the Member States to make use of the “major events” listing, this could, on the long run, limit the rise of the broadcasting revenues for FIFA.

The marketing rights (see graph 5) constitute the second leg of FIFA’s financial income stream. They have been constantly growing since 2003. From 168 Million$ in 2003 to 419 Million$ in 2013, reaching quasi 150% growth (at constant prices). In recent years, this has been a more dynamic revenue stream than broadcasting rights, but it has remained less important in absolute terms. It seems that the FIFA Partners Programme launched by FIFA, probably inspired by the TOP Programme created by the IOC, is a tremendous success. Nowadays, marketing rights constitute 30 to 35% of FIFA’s total revenues. Together, broadcasting revenues and marketing rights amount to a staggering 75 to 85% of FIFA’s total revenues. A share which remained more or less stable over the latest years (see Graph2).

The rather minor revenue streams are constituted by the FIFA hospitality rights, licensing and brand licensing revenues. Hospitality rights revenues (Graph 6) are a relic from the past. They derive from the profits made by MATCH Hospitality, the sole company authorised by FIFA to offer and guarantee exclusive hospitality packages for every match of the FIFA World Cup directly or through its appointed sales agents. With the competition of internet-based travel agencies and the evolution of the ticketing system of FIFA under the pressure of the European Commission, the revenues of match hospitality have been dwindling over the last 10 years.

The FIFA licensing programme (Graph 7) derives its revenues from fixed royalty payments and variable profit shares paid for the use of the FIFA brand. FIFA’s licensing programme covers a broad range of activities, including for example numismatic and philatelic collections and the more classical retail & merchandising. After a peak at the World Cup 2006 in Germany, where FIFA licensing brought in 51 Million$, licensing revenues have remained more or less stable averaging at 10 to 20 Million$ a year.

Another closely related, but distinct for accountancy purposes, income stream, is the one generated by brand licensing (Graph 8). Five companies dispose of a specific agreement with FIFA: Adidas, Electronic Arts, Hublot, Louis Vuitton and Panini. Each of these companies holds a licence to use the FIFA Brand Marks in the advertising, marketing, promotion and sale of its licensed products or programmes. These long-term licensing agreements bring in more and more money, from 5 Million$ in 2003, to 58 Million$ in 2013. The biggest jump for a category of FIFA revenues.  Its success is exemplified by the world-wide fame of the eponym Electronic Arts video game: FIFA. However, all three revenue streams amount to less than 10% of FIFA’s total revenues in 2013, the lion share is still constituted by the broadcasting rights.

Conclusion: Get rich and die getting richer?

Economically the last 10 years have been a phenomenal success for FIFA. Its revenues have grown substantially and it has, to some extent, managed to diversify its revenue streams. Indeed, FIFA is less and less dependent on broadcasting revenues, while relying more and more on marketing and brand licensing income streams. This diversification appears judicious as the broadcasting market seem to be losing steam, especially in light of a public will, at least at the European level, to control and tame the monopoly of FIFA over the broadcasting of the World Cup. Thus, FIFA is in a paradoxical situation. It will enter its congress engulfed in an unending governance crisis, but financially it looks as profitable as ever. In some way the big leap forward of FIFA’s recent, and highly successful, commercialization might cause the existential crisis it is now confronted with. Indeed, all this fresh money influx may have destabilized even more a governance system prone to favour nepotism. Hence, the paradox might be that FIFA got rich and might die (at least as we know it) because of it. This is also connected to the way FIFA distributes the revenues it collects, which will be the focus point of the second part of this blog series.

Sport and EU Competition Law: uncharted territories - (I) The Swedish Bodybuilding case. By Ben Van Rompuy

The European Commission’s competition decisions in the area of sport, which set out broad principles regarding the interface between sports-related activities and EU competition law, are widely publicized. As a result of the decentralization of EU competition law enforcement, however, enforcement activity has largely shifted to the national level. Since 2004, national competition authorities (NCAs) and national courts are empowered to fully apply the EU competition rules on anti-competitive agreements (Article 101 TFEU) and abuse of a dominant position (Article 102 TFEU).

Even though NCAs have addressed a series of interesting competition cases (notably dealing with the regulatory aspects of sport) during the last ten years, the academic literature has largely overlooked these developments. This is unfortunate since all stakeholders (sports organisations, clubs, practitioners, etc.) increasingly need to learn from pressing issues arising in national cases and enforcement decisions. In a series of blog posts we will explore these unknown territories of the application of EU competition law to sport.

We kick-start the series with a recent investigation of the Swedish National Competition Authority (NCA) into a so-called duty of loyalty clause applied by the Swedish Bodybuilding and Fitness Federation (Svenska Kroppskulturförbundet, SKKF).[1]

The facts

The SKKF is the only national member of the International Bodybuilding Federation (IFBB) and organises various championships in the sport of bodybuilding and fitness in Sweden. It is essential for Swedish clubs, individual athletes, and officials to be a member of the SKKF as this is prerequisite for participation in IFBB international competitions.

The IFBB’s rules and regulations form an integral part of the SKKF’s Statutes. According to the SKKF’s rules, members who compete or otherwise participate in contests that are not approved or authorised by the SKFF or IFBB can be fined or suspended (i.e. the duty of loyalty clause). Athletes who have taken part in an unsanctioned event must also test for doping, at their own expenses, before they are allowed to compete at SKKF or IFBB events again.

In October 2013, BMR Sport Nutrition AB, a manufacturer of nutritional and bodybuilding supplements that also occasionally organises unsanctioned bodybuilding and fitness events in Sweden, filed a complaint before the NCA alleging that this rule violates Article 101 TFEU and Chapter 2, Article 1 of the Swedish Competition Act as it prevents event organisers from effectively competing with the SKKF (i.e. they are deprived from the chance to gather the human resources necessary for a successful event). The complainant submitted evidence that the threat of a fine and/or the withdrawal of their license by the SKKF effectively deterred athletes from participating in non-sanctioned events.


The context

The Swedish bodybuilding case follows a 2011 decision of the NCA, which ordered the Swedish Automobile Sports Federation (Svenska Bilsportförbundet, SBF) to abolish its rules preventing members from participating in motorsport events not authorized by the KKF.[2] On appeal by SBF, the Swedish Market Court upheld the decision in its entirety.[3]

This “precedent” case dealt with two duty of loyalty clauses in the SBF’s Common Rules prohibiting officials and contestants, licensed by the SBF, to officiate or participate in motor sport events other than those organised by the SBF or its member clubs. A violation of these provisions could result in a fine and/or withdrawal of the licence to officiate or compete in SBF events.

The NCA and the Market Court established that the contested rules constituted a decision by an association of undertakings. While the NCA had only applied national competition law, the Market Court, having defined the organisation of motorsport competitions in Sweden as the relevant product market, found that trade between the Member States was affected and therefore also applied Article 101 TFEU. According to the Court, the mere existence of the rules considerably distorted competition because they led to an absolute ban for SBF members to participate in non-sanctioned events. It concluded that, even if the rules would be regarded as serving a legitimate objective, the total ban could not be considered proportional to achieving such an objective. Moreover, the Court concluded that the restriction of competition could not benefit from an exemption under Article 101(3) TFEU or Chapter 2, Article 1 of the Swedish Competition Act.

While the Market Court’s judgment is far from innovative and carefully followed the proportionality test adopted by the Court of Justice in Meca-Medina, the case drew much media attention and raised concerns and criticism from the Swedish sports movement. Having demonstrated the remedial potential of EU competition law to challenge organisational sporting rules, it was only a matter of time before further national enforcement action would result from this case. 


The outcome

In a statement responding to the filing of the complaint by BMR Sport Nutrition AB, the chairman of the SKKF contested the apparent analogy with the SBF (motorsport) case. He essentially put forward three reasons. First, the SKKF is a non-profit organisation that pursues an aim in the general interest (i.e. the promotion of sport) and reinvests all its income, which is insufficient to cover its costs, in its sports activities, e.g. to fund education and training activities, doping tests, and travel expenses of the national team. This precludes the assumption that it pursues an economic activity. It follows that the SKKF cannot be regarded as an undertaking for the purposes of competition law (contrary to commercially successful sports associations). Second, the SKKF does not act independently of the will of its members. Similar to trade unions, member athletes voluntarily submit themselves to the applicable regulations when they join a member club. They can move to change certain rules if they find, in a true democratic spirit, a majority for such change. Alternatively, member athletes can choose to leave their club and join another association. Third, the right of freedom of association excludes the rule-making powers of the SKKF from the ambit of the competition rules.

Nevertheless, following several meetings between the NCA and the SKKF, the latter committed no longer to suspend or fine athletes, coaches, officials or judges that participate in non-sanctioned events.[4] The requirement that they must test for doping, at their own expense, was not abolished. According to the SKFF, this requirement was necessary to comply with the IFBB anti-doping rules, which conform to the provisions of the World Anti-Doping Code.

Given the commitment of the SKKF to no longer apply the duty of loyalty clause, the NCA decided to close the investigation without concluding whether competition law had been infringed.


Commentary

Those familiar with sports-related competition law cases will surely recognize the arguments of the chairman of the SKKF to assert immunity from the application of the competition rules. While they have been tried and tested many times, also before the Union courts, these arguments keep popping up. So let’s take a closer at why they are not accepted.

Regarding the claim that the SKKF is a non-profit organisation that exclusively aims to promote the development of the sport, it must be recalled that – if there still was any doubt - in Meca-Medina the Court of Justice made clear that the qualification of a rule as “purely sporting” was insufficient to remove the body adopting that rule (or the person engaging in the activity covered by it) from the scope of the Treaty. It thus must be examined, irrespective of the nature of the rule, whether the specific requirements of the various provisions of the Treaty are met. For the purpose of the competition rules, the notion of “undertaking” is a core jurisdictional element. According to established case law, this concept covers “any entity engaged in an economic activity regardless of the legal status of the entity or the way in which it is financed”.[5]

In an attempt to escape the bite of the competition rules, various other sports associations have time and again asserted that they cannot be regarded as “undertakings” because their objective is not the pursuit of economic interests. Even when only considering their regulatory functions, this reasoning finds no support in the case law. The Court of Justice has consistently held that the concept of undertaking does not presuppose a profit-making intention. The fact that entities are non-profit making has no effect on their classification as undertakings.[6] Similarly, the fact that entities pursue cultural or social activities does not in itself prevent these activities from being regarded as economic.[7]

In the case at hand, it is clear that in addition to the SKKF, even assuming that it organises bodybuilding and fitness events without seeking to make profit, other entities like BMR Sport Nutrition AB are also engaged in that activity (and do seek to make a profit). The SKKF offers goods or services on a market in competition with others. The success or economic survival of the SKKF ultimately depends on it being able to impose its services to the detriment of those offered by other event organisers. Consequently, the SKKF must be considered as an undertaking engaged in the markets for the organisation and marketing of bodybuilding and fitness events.

Regarding the somewhat chucklesome claim that the SKKF should be qualified as a trade union (or other professional association) that cannot act independently of the will of its members, it is sufficient to stress that Article 101 TFEU also applies to “associations of undertakings”. A federation like the SKKF, the beacon of democracy it may be, is not an association of employees but (also) of member clubs that engage in economic activities. Hence, the result of the delimitation between the federation acting “in its own right” or “merely as an executive organ of an agreement between its members” is irrelevant: Article 101 TFEU still applies to its regulations.

Regarding the claim based on the principle of freedom of association, indeed protected in the Swedish constitution as well as in the EU legal order, it is difficult to see how the duty of loyalty clause could be considered an inevitable result thereof. In any event, the Court of Justice has made clear that this right cannot be so absolute as to afford sports federations’ complete immunity from EU law.[8] In other words, the need to guarantee sports’ right of self-regulation cannot be a blank check to avoid scrutiny of measures that may conceal the pursuit of economic interest. Provided that its rules are proportional to a legitimate objective, SKKF should have nothing to fear from the competition rules.

So contrary to what the chairman of the SKKF contented, the analogy between its rule and the contested rule in the SBF (motorsport) case was accurate. A confrontation with this inconvenient truth was sufficient to convince the SKKF to commit itself to no longer suspend or fine athletes, coaches, officials or judges for participating in non-sanctioned competitions. That the requirement of a doping test (for those having participated in competing events) could remain clearly illustrates that competition law will leave unscratched restrictive sporting rules that are deemed inherent and proportionate to the organisation and proper conduct of sport. It almost makes you wonder what all the fuss is about when competition law confronts the world of sport.

One final note: the contested “SKKF” rule is the national equivalent of the clause contained in the IFBB Constitution (which forms an integral part of the SKKF’s statutes). Article 19.4.7 stipulates that:

“Any athlete or official who participates in a competition or event not approved or sanctioned by the IFBB, may be fined, suspended or expelled. The amount of the fine as well as the suspension period will be decided by the IFBB Disciplinary Commission … Once the suspension has been completed and before participating in an IFBB competition or event, the athlete must be drug tested at his or her own expenses”

Participation in an event or competition includes (but is not limited to!) competing, guest posing, giving a seminar, lecture or similar presentation, judging, officiating, allowing the use of one’s name and/or likeness for promotional purposes, and/or taking part in a non-IFBB sanctioned competition or event in any other way, shape or form.

To the IFBB and all other European member federations, who have to the author’s knowledge not decided to no longer enforce or abolish this rule: beware!

Tapping TV Money: Players' Union Scores A Goal In Brazil. By Giandonato Marino

On March 27, 2014, a Brazilian court ruling authorized the Football Players’ Union in the State of Sao Paulo[1] to tap funds generated by TV rights agreements destined to a Brazilian Club, Comercial Futebol Clube (hereinafter “Comercial”). The Court came to this decision after Comercial did not comply with its obligation  to pay players’ salaries. It is a peculiar decision when taking into account the global problem of clubs overspending and not complying with their financial obligations.  Furthermore, it could create a precedent for future cases regarding default by professional sporting clubs.

In 2013, 19 players were victims of financial mismanagement of the football club based in Ribeirao Preto. This year, with the problem still unresolved, the 19 players once again were facing financial distress. The total sum that Comercial still owed players, which consisted of overdue salaries, social security contributions and severance pay after contract expiration, amounted to R$ 363,147.71, or €120,000.00. By means of meeting the player’s demands, Comercial had issued unredeemed cheques in order to pay part of the salaries of the Players before this year’s carnival. To receive the salaries Comercial owed, the Players’ Union filed a complaint against Comercial in front of the Labour Court of Ribeirao Preto, representing eight players who are members of the Union. It asked, inter alia, for a provisional measure that would freeze  the amount that Comercial would receive from the Football Federation of Sao Paulo and the Brazilian television network Rede Globo for the TV rights. Rede Globo is the biggest broadcasting company in Brazil and holds the rights to broadcast the main competitions in football, including the upcoming FIFA World Cup. For Comercial, this would mean not receiving up to €850,000.00 from the Football Federation of Sao Paulo for the TV rights agreement. The agreement included the broadcasting of the Campeonato Paulista, for which Comercial was to be paid in four instalments (January, February, March and April 2014). At the time of the request, three out of four instalments had already been paid. Therefore, the Players’ Union could only acquire the amount of the fourth instalment due in April 2014, equal to €210,000.00.

In accordance with the tradition of Roman Law, on which the Brazilian legal system was developed, the Court had identified the existence of both legal requirements in order to issue a provisional measure: fumus boni juris, i.e. that the claim has a reasonable prospect of success and periculum in mora, i.e. the danger that claimant's rights may be impaired by the lapse of time. Regarding the first requirement, the Court established (in accordance with Article 335 of Brazilian Civil Procedural Code[2]) that Comercial had issued cheques that afterwards could not be claimed by the players. As regards the second requirement, the Court took in consideration the fact that Comercial was relegated to the second division of the Sao Paulo State League[3] and that the players were dismissed.

As a consequence, the Court accepted the request of the Players’ Union, and ordered the Football Federation of Sao Paulo and Rede Globo to deposit the amount that was due to CFC on the Union’s bank account instead. Whether Comercial exerted its possibility to challenge this measure within five days is yet unknown.

This decision is, to our knowledge, a novel and efficient method (from the point of view of the players) to tackle the problem of unpaid salaries in the world of football. It has, therefore, also been welcomed by FIFPRO. The measure issued in this particular case is of limited importance, because it only applies to the eight players affiliated to the Players’ Union. However, the method used by the Union, ceasing the TV rights income directly, might prove very useful for players in similar situations worldwide, it ensures that, even in case of default of their employers, the contractual demands of the players can be satisfied.

The Olympic Games and Human Rights – Part II: Human Rights Obligations Added to the Host City Contract: Turning Point or Empty Promise? – By Tomáš Grell


This is a follow-up contribution to my previous blog on human rights implications of the Olympic Games published last week. Together with highlighting some of the most serious Olympic Games-related human rights abuses, the first part has outlined the key elements of the Host City Contract ('HCC') as one of the main legal instruments regulating the execution of the Olympic Games. It has also indicated that, in February 2017, the International Olympic Committee ('IOC') revised the 2024 HCC to include, inter alia, explicit human rights obligations. Without questioning the potential significance of inserting human rights obligations to the 2024 HCC, this second part will refer to a number of outstanding issues requiring clarification in order to ensure that these newly-added human rights obligations are translated from paper to actual practice.


Implementation of Agenda 2020 into the HCC 

In December 2014, the IOC Session unanimously approved Olympic Agenda 2020 ('Agenda 2020'), a set of 40 recommendations intended to protect the uniqueness of the Games and strengthen Olympic values in society. Agenda 2020 makes five specific recommendations with respect to the HCC which should have been taken into account as of the 2022 HCC concluded between the IOC on the one hand and the City of Beijing and the Chinese Olympic Committee on the other hand.[1]

Most importantly, Agenda 2020 encourages the IOC to include in the HCC clauses reflecting the prohibition of discrimination as well as the protection of environmental and labour-related rights.[2] Fundamental Principle 6 of the Olympic Charter, now also reflected in Article 13.2. (a) of the 2024 HCC, reads as follows: ''The enjoyment of the rights and freedoms set forth in this Olympic Charter shall be secured without discrimination of any kind, such as race, colour, sex, sexual orientation, language, religion, political or other opinion, national or social origin, property, birth or other status.'' Non-discrimination on the basis of sexual orientation had been absent from the Olympic Charter prior to Agenda 2020. As far as environmental and labour-related matters are concerned, the Host City, the Host National Olympic Committee ('Host NOC') and the Organising Committee of the Olympic Games ('OCOG') are obliged under the 2024 HCC to ''ensure that their activities in relation to the organisation of the Olympic Games comply with any international agreements, laws and regulations applicable in the Host Country, with regard to planning, construction, protection of the environment, health and safety, labour and working conditions and cultural heritage''.[3] For the first time, the 2024 HCC also makes a specific reference to the United Nations' Sustainable Development Goals.[4]

In addition to promoting non-discrimination, environmental protection and labour-related rights, Agenda 2020 also fosters transparency by demanding the IOC to: (i) make the HCC public; (ii) disclose details of the IOC's financial contribution to the OCOG; and (iii) provide the HCC at the outset of a bidding procedure.[5] Moreover, Agenda 2020 suggests that entities other than the Host City and the Host NOC may become signatories to the HCC in line with the local context.[6]

 

What exactly has been added to the 2024 HCC?

As indicated above, the prohibition of discrimination,[7] and to a certain extent also the protection of labour-related rights,[8] appeared for the first time in the 2022 HCC, reflecting the recommendations laid down in Agenda 2020.[9] Moving to the 2024 HCC, the core human rights provision inserted therein demands that the Host City, the Host NOC and the OCOG in their activities related to the execution of the Games ''protect and respect human rights and ensure any violation of human rights is remedied in a manner consistent with international agreements, laws and regulations applicable in the Host Country and in a manner consistent with all internationally-recognized human rights standards and principles, including the United Nations Guiding Principles on Business and Human Rights, applicable in the Host Country''.[10] Of particular importance is the explicit reference to the United Nations Guiding Principles on Business and Human Rights ('UN Guiding Principles'), a non-binding legal framework intended to minimize adverse human rights impacts triggered by business activities. The UN Guiding Principles are based on three pillars, namely (i) the State duty to protect human rights; (ii) the corporate responsibility to respect human rights; and (iii) access to remedy.

The following sections will address some of the issues that remain outstanding even after the insertion of human rights obligations to the 2024 HCC.

No direct involvement of the Host Country

First and foremost, the Host Country itself is not directly obliged to protect and respect human rights under the 2024 HCC. Instead, the provision discussed above imposes human rights obligations on the Host City, the Host NOC and the OCOG. It is critical to note that the relevant provision requires the Host City, the Host NOC and the OCOG not only to respect, but also to protect human rights, suggesting that these entities shall take positive actions to facilitate the enjoyment of human rights. This begs the question whether the Host City, the Host NOC and the OCOG have the political, legal and financial capacity to effectively take such positive actions.

For instance, the Host City and the OCOG would be expected to include human rights obligations in their contracts with suppliers of public infrastructure and sporting facilities. However, even if they do so under the threat of contract's termination and further sanctions, it may not suffice to prevent Olympic Games-related human rights abuses from occurring. Unlike the Host Country Authorities, the Host City, the Host NOC and the OCOG do not possess the necessary powers to monitor and adjudicate the human rights compliance of their sub-contractors. Furthermore, much of the infrastructure build-up might be conducted by the Host Country directly and would therefore evade the scope of application of the HCC.

Who determines when human rights obligations are violated? 

In practice, human rights obligations arising out of a contractual relationship are not easy to deal with, because it might be rather difficult to decide whether they have been observed or not. For this reason, it is essential to entrust an independent body with competence to decide whether the Host City, the Host NOC or the OCOG have complied with their human rights obligations under the HCC. Unfortunately, the 2024 HCC in its current form does not stipulate who is responsible for adopting a decision determining that the Host City, the Host NOC and the OCOG are in breach of their human rights obligations. 

It follows that the IOC itself (via the Coordination or Legal Affairs Commission) may take on this inquisitorial and quasi-judicial role. However, this would lead a very interested party to monitor and adjudicate the human rights compliance of the Host City, the Host NOC and the OCOG. The potential for a conflict of interests is evident, as the IOC could face negative financial and other consequences if it decides to withdraw the Games from the Host City, the Host NOC and the OCOG. In this configuration, the incentives will therefore be strongly opposed to finding for a lack of compliance.

Instead, we could imagine a separate, truly independent body consisting of NGO members, athletes' representatives, union representatives, CAS arbitrators and independent experts (such as academics or judges at the European Court of Human Rights). This body could have an investigative and an adjudicative chamber (not unlike the FIFA Independent Ethics Committee), ensuring a separation between monitoring and adjudicating. Should the Host City, the Host NOC or the OCOG consider sanctions imposed under such a mechanism arbitrary, they might still activate the CAS arbitration clause[11] and challenge the validity of these sanctions before the CAS.

Will the sanctions contemplated by the HCC be effective? 

As explained in the first part of this blog, the most severe sanction contemplated by the HCC in the event of non-compliance is the withdrawal of the Games from the Host City, the Host NOC and the OCOG with prior notice.[12] It should be emphasized, however, that a removal of the Games would result in both financial and reputational harm being incurred by the IOC.[13] Therefore, it is arguable whether the IOC would in practice be ready to withdraw the Games. In fact, the IOC has withdrawn the Games so far only due to the outbreak of the First and Second World War, when the Games were cancelled altogether.[14] Being aware of the IOC's unwillingness to withdraw the Games, the Host City, the Host NOC and the OCOG may not perceive the threat of losing the Games as credible. Consequently, these entities may not feel obliged to adhere to their human rights obligations under the HCC.

With regard to other enforcement measures, the IOC is entitled, inter alia, to retain all amounts held in the General Retention Fund[15] or withhold any payment due, or grant to be made to the OCOG pursuant to the HCC.[16] By not providing the relevant financial contribution to the OCOG, the IOC would risk delays in construction and other preparatory works – something the IOC certainly wants to avoid. Eventually, these sanctions might prove to be as inefficient as the threat of losing the Games, given that the IOC may turn a blind eye to violations of the HCC in order to safeguard its financial and other interests. Besides financial considerations, the IOC's reluctance to impose sanctions on the Host City, the Host NOC and the OCOG follows from the fact that the IOC would thereby implicitly acknowledge its mistaken decision to award the Games to a particular Host City in the first place.

 

Conclusion

This blog has identified three specific concerns potentially relativizing the impact of the human rights obligations recently added to the 2024 HCC. First, the Host City, the Host NOC and the OCOG as the formal addresses of these obligations may not have the capacity to ensure the human rights compliance of their sub-contractors. Second, the 2024 HCC in its current form lacks clarity as to when the Host City, the Host NOC and the OCOG are in breach of their human rights obligations and who is responsible for adopting a decision to that effect. Third, being aware of the IOC's unwillingness to withdraw the Games due to financial and other interests involved, it is likely that the Host City, the Host NOC and the OCOG might refuse to abide by their human rights obligations under the HCC. This is not to say, however, that introducing human rights requirements is not an important step forward, but as always with this type of decisions the devil will be in the implementation.
